Terms of Service
Effective date: April 11, 2026
These Terms of Service ("Terms") govern your use of the PreCase AI website ("Site") and the PreCase AI desktop application ("App"), provided by PreCase AI LLC ("PreCase," "we," "us," or "our"). By accessing the Site or using the App, you agree to these Terms. If you do not agree, do not use our services.
1. What PreCase Is (and Is Not)
PreCase AI is a software tool for organizing communications and evidence. PreCase is not a law firm, does not provide legal advice, and is not a substitute for a licensed attorney.
PreCase helps you organize messaging history, highlight communication patterns, and prepare attorney-ready evidence packages. It does not analyze your legal situation, assess threats, make legal determinations, or tell you what to do. Any output generated by PreCase AI — including summaries, suggested groupings, communication pattern highlights, and suggested communication approaches — is for informational purposes only.
You must consult a qualified attorney in your jurisdiction before making any legal decisions. Do not rely on PreCase output as a substitute for professional legal counsel.
2. No Warranty of Accuracy
The analysis, suggestions, and summaries generated by PreCase AI are produced by artificial intelligence and may be incomplete, inaccurate, or inapplicable to your jurisdiction. These outputs are intended to help you organize information for discussion with your attorney — they are not legal determinations.
PreCase makes no warranty, express or implied, regarding the accuracy, completeness, reliability, or suitability of any AI-generated content. You use all outputs at your own risk.
3. Acceptable Use
You agree to use PreCase only for lawful purposes. You may not:
- Use PreCase to harass, threaten, or intimidate any person
- Submit content that you do not have the right to use
- Attempt to reverse-engineer, decompile, or extract the source code of the App
- Use PreCase output to misrepresent AI-generated content as professional legal advice
- Interfere with the operation of the Site or any related infrastructure
4. User Responsibility
You are solely responsible for any decisions or actions you take based on information organized or presented by PreCase. The decision to use any material prepared with PreCase — including sharing it with your attorney, submitting it in legal proceedings, or acting on AI-generated suggestions — is yours alone.
You assume all risk for acting on AI-generated output without the review and guidance of a qualified attorney.
5. Intellectual Property
The PreCase name, logo, Site content, and App software are the property of PreCase AI LLC. You retain ownership of any data you provide to the App. Nothing in these Terms grants you any right to use our trademarks, branding, or proprietary materials beyond normal use of the product.
6. Privacy
Your use of PreCase is also governed by our Privacy Policy, which describes what data we collect and how we handle it.
7. Limitation of Liability
To the maximum extent permitted by applicable law, PreCase AI LLC and its officers, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages — including but not limited to loss of data, loss of profits, legal fees, or damages arising from legal proceedings — resulting from your use of or inability to use the Site or App, or from any AI-generated content provided by PreCase.
In no event shall our total liability exceed the amount you paid to PreCase AI LLC in the twelve (12) months preceding the claim, or fifty dollars ($50.00), whichever is greater.
8. Indemnification
You agree to indemnify, defend, and hold harmless PreCase AI LLC and its officers, employees, and agents from any claims, damages, losses, or expenses (including reasonable attorneys' fees) arising from: (a) your use of PreCase; (b) your reliance on AI-generated content without independent legal counsel; (c) your violation of these Terms; or (d) your violation of any applicable law.
9. Changes to These Terms
We may update these Terms from time to time. If we make material changes, we will update the effective date at the top of this page. Your continued use of PreCase after changes are posted constitutes acceptance of the revised Terms.
10. Governing Law
These Terms are governed by the laws of the State of Delaware, without regard to its conflict of laws provisions. Any disputes arising under these Terms shall be resolved in the state or federal courts located in Delaware.
